Ballard Development: Two subdivisions granted; Comment on Shoreline Master Plan amendment proposals

The Department of Planning and Development has announced two decisions for land use applications in Ballard. Both applications were for subdivisions. Appeals for these decisions must be received by the Hearing Examiner no later than 4/6/2015.
The DPD is also accepting comments for proposed amendments to the Shoreline Master Plan.
DPD decisions:
1717 NW 64TH ST: Granted
Land Use Application to subdivide one development site into two unit lots. The construction of residential units is under Project #6409239. This subdivision of property is only for the purpose of allowing sale or lease of the unit lots. Development standards will be applied to the original parcel and not to each of the new unit lots.
5917 20TH AVE NW: Granted

Shoreline Master Plan amendments:
On March 17, 2015 the Council’s Planning Land Use and Sustainability Committee considered amendments to Council Bill 118311. These amendments add to or modify the Mayor’s proposal to update the Shoreline Master Program (SMP). Some amendments to Council Bill 118311 would constitute a change to development regulations for the purposes of the Growth Management Act (R.C.W. Chapter 36.70A). Generally, the proposed amendments would:
▪ Clarify that, where authorized, house barges are an allowed over water use on waterfront lots;
▪ Clarify where open railings may be added to house barges and floating on-water residences;
▪ Clarify that failure to update the Department of Planning and Development (DPD) Director when house barges and floating on-water residences are relocated is not a violation of the SMP that would forfeit an owner’s right to maintain the use;
▪ Change the verification process for house barges and floating on-water residences to no longer require issuance or display of a plate with a verification number;
▪ Modify the definition of floating on-water residence to clarify that chain of title can be used meet the definition;
▪ Clarify that office uses on upland lots in the Urban Maritime environment are not shoreline conditions uses;
▪ Because other development standards establish a residential use limitation for house barges and floating on-water residences, remove redundant use-limitation language for floating on-water residences and house barges;
▪ Modify development standards that authorize the DPD Director to determine the number and type of hygiene facilities that may be required for new marinas or existing marinas undergoing substantial development; and
▪ Correct typographical errors, omissions, and punctuation.
Based upon public comments and Council deliberations, the amendment or amendments ultimately adopted, if any, may be different than the amendments summarized above. The amendments adopted may be combined in a new Council Bill.
WRITTEN COMMENTS
Written comments may be submitted at any time until the final Council vote on the legislation. However, the Council prefers to receive written comments by 12:00 p.m. on April 3, 2015 to allow for review by the Council during its consideration of the proposal.
