MITIGATED DETERMINATION OF NON-SIGNIFICANCE
Description of Proposal:
Construction of six retail buildings totaling approximately 53,000 square feet on a 5.62 acre parcel comprising two tax lots. The project is located at 19919 - 1st Ave. South in Normandy Park, Washington 98166 on tax lots #6115400142 and #6115400138.

The City of Normandy Park has determined that the above described proposal does not have a probable significant adverse impact on the environment. An environmental impact statement (EIS) is not required under RCW 43.21C.030(2)(c). This decision was made after review of a complete environmental checklist and other information on file with the lead agency. The information is available to the public on request.
This MDNS is issued under WAC 197-11-340(2); the lead agency will not act on this proposal for 14 days from the date of issuance. Any interested party may submit written comments on this proposal. Written comments must be submitted to the Normandy Park Planning Department before 5:00 pm, August 11, 2006.
You may appeal this determination in writing to the City of Normandy Park no later than 5:00 pm, August 25, 2006, at the address listed below. Written appeals should be directed to the City Clerk and must include specific factual objections regarding this determination, your name and contact information and an appeal fee. Contact the Planning Department to receive information on specific procedures for SEPA appeals.

MITIGATING MEASURES
The following conditions are imposed to mitigate (a) specific environmental impact(s) identified in the Environmental Checklist and other information on file with the City:
1. Applicant must comply with roadway improvement requirements of City of Normandy Park and Washington State Department of Transportation for 1st Avenue improvements.
2. Applicant shall provide street frontage improvements along 1st Avenue frontage as described in the Normandy Park Design Guidelines (Ordinance 743) and as required by the Washington State Department of Transportation guidelines.
3. Applicant shall provide for transit stops on the east and west sides of 1st Avenue as designated by King County Transit Department. Applicant shall provide sidewalks from 199th Street intersection with 1st Avenue north to the transit stop on the east side of 1st Avenue.
4. Applicant shall provide pedestrian sidewalk, street trees and landscaping as provided on the approved site development plan along applicant's portion of 1st Avenue and 200th Street SW frontage.
5. Applicant's project traffic will impact city streets, but will not result in a reduction of the traffic Level of Service below "B" on 1st Avenue. No system wide mitigation is required.
6. Applicant must comply with WSDOE and City of Normandy Park erosion control requirements during construction.
7. Applicant must provide either a Level 3 detention using the 1998 King County Surface Water Design Manual using historic site conditions as the existing conditions. Applicant shall evaluate and include the following:
a. Proposal for water quality treatment and detention for the site.
b. Proposal for conveying any offsite runoff through the site.
c. Implementation of projects identified for this site in the Surface Water Comprehensive Plan.
Or the Applicant can provide an analysis using the 1998 King County Surface Water Design Manual and Impact Mitigation Core requirement 1.2.2.2 and Problem Specific Mitigation requirement (f) "Provide a combination of additional onsite flow control and offsite improvements sufficient to prevent creation or significant aggravation of the downstream problem(s) as demonstrated by a Level 2 or Level 3 downstream analysis."
8. Applicant shall assure that grading operations on the site will not negatively impact the adjacent properties with respect to undercutting or overfilling at the property line or with respect to drainage.
9. All development shall conform to the Normandy Park Design Guidelines (Ordinance 743).
10. Construction activity shall be limited to 7 AM to 5 PM Monday through Friday and 9 AM to 5 PM on Saturday. There shall be no construction activity on Sunday.
11. All electrical utilities must be underground.
12. Applicant shall provide Type I landscaping and topographic changes to screen adjacent residential units from commercial uses.
13. Excessive light or glare shall not project outside boundaries of the project.
14. Applicant shall pay all City of Normandy Park fees and all City consultant fees and administrative fee required per the NPMC as of the date of the MDNS to review this project.
