A second-degree rape charge has been filed by the King County Prosecutor’s office against West Seattle resident Chantae Marie Gilman stemming from an incident last summer. After analysis of DNA samples taken from the victim and the accused were finished being tested the charges were officially filed earlier this month.
“Although it is not common to have a woman as a rape suspect, it is also not unheard of,” said Rich Anderson, Senior Deputy Prosecuting Attorney with King County of the allegations.
The incident in question took place in the early morning hours of June 17, 2013 when the victim, a 31 year old male, awoke after a night of partying to find Gilman, a 28 year old woman he had never met, on top of him and in the act of having sexual relations with him. Once the victim realized what was happening he demanded that Gilman leave his apartment and struggled to get out from under her once she refused to leave or stop what she was doing.
According to charging documents Gilman and the victim at that time were neighbors living on the 9200 block of 18 Ave. S.W. who shared a common friend in another neighbor.
The victim told authorities that he knew of Gilman from seeing her around the neighborhood and described her as a “drug user”.
On June 16, 2013 the victim was at a birthday party being held by the neighbor friend that he and Gilman until later that night when he walked back to his apartment and fell asleep. When he awoke he found his hands pinned above his head and Gilman on top of him. Once the victim managed to push her out of his apartment he went to Harbor View Medical Center for a sexual assault examination.
It is the DNA samples that were collected from this examination and later matched against another sample that Gilman provided to authorities which is being used as evidence to charge her.
One count of second-degree rape was filed against Gilman. A bail of $100,000 dollars has been set as well as a “no contact” order with the victim.
“She has not been charged with a rape by forcible compulsion or violence – in this case, she has been charged under the theory that the victim was not able to consent to sexual intercourse by virtue of being unconscious and therefore physically helpless,” clarified Anderson of the charge.
When asked about the delay in filing charges Anderson replied “it appears as though the lab tests were not completed until early this summer, followed by some routine communication and paperwork between the referring police agency and our office”.
Currently pregnant and believed to be in a treatment center for addiction, Gilman told authorities that she does not remember the nigh in question and that she suffers from multiple mental illnesses. She further told authorities that she does not remember having ever met the victim.
