Facing foreclosure, Vera Johnson, owner of Village Green Perennial Nursery is hoping to either prevent the process from going forward or come up with an alternative plan. She's meeting with legal experts and small business advisors.
The latest development in the story of Village Green Nursery owner Vera Johnson's foreclosure by Bank of America happens Sunday night at 5:00 pm at the Commmunity School of West Seattle. Johnson and other people facing foreclosure in the community will have a chance to talk to attorney Edgar I. Hall of the Law Offices of Mark McClure P.S. from Kent.
Johnson who has banded with others in a similar situation told the West Seattle Herald that Hall is an expert in this area of law. "I think we all agreed and he actually told me that this is not a potential class action lawsuit because every situation is so different but I think it's just going to provide us with resources for lawyers who can work pro-bono (free). He's going to help us know what to look for and to look for any fraudulent documents. Without (finding) fraudulent documents the banks are just going to get away with it."
Johnson alluded to the problem of what is called "robo-signing". Robo-signing, is a term meaning the automatic generation of documents. The term and practice have gotten media attention in the past couple of years with regard to mortgage arrears and foreclosure notices leading to the loss of homes without a bank employee having even read the relevant foreclosure documents. Lenders must by law be able to produce a sworn affidavit verifying that the trust owns the mortgage in question, and that it is at least six months in arrears.
Johnson's next appointment with the bank regarding her imminent foreclosure is Tues. Aug 2 but in preparation she's meeting with S.C.O.R.E. a division of the Small Business Administration in hopes that an alternative path can be forged. One that could, in her estimation, create a happy resolution. She's seeking advice and direction on pursuing growing a wedding business on the 7/8 acre site.
